Welcome! Please read these Terms carefully because they are a binding agreement between You and HiveMQ, Inc. and HiveMQ GmbH (together, “HiveMQ,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of https://www.hivemq.com (the “Website”) and your use of the websites that link to these Terms. In these Terms, the word “Sites” refers to the Website and each of the websites and the services offered on those Sites that link to these Terms, including but not limited to any AI Agents.
By accessing, using or logging into the Sites you agree to these Terms and to the Privacy Policy. If you do not agree, please do not use the Sites.
Your use of HiveMQ products or services may be governed by separate agreements described and/or incorporated below. These Terms apply to the Sites and supplement product agreements as applicable. In the event of any conflict, the applicable product and services agreement controls.
The Sites are primarily designed to provide information about HiveMQ and its offerings, and may also allow you to create an account, log in, access content, interact with tools, or use features made available through the Sites, including AI Agents, whether or not you purchase or use any HiveMQ products or services.
These Terms govern your access to and use of the Sites, including any account access, interactions, content, tools, and AI Agents made available through the Sites. They apply regardless of whether you later purchase, trial services, or use any HiveMQ products and services.
Your access to or use of specific HiveMQ products and services may also be governed by one or more separate agreements, which are made available through HiveMQ’s Legal Page or through applicable checkout, onboarding, order form, account, or partner processes.
Acceptance of those product and service agreements occurs outside of these Terms, including through: (i) online checkout or clickwrap acceptance; (ii) execution of an order form or activation of a subscription; or (iii)account-based activation flows.
If there is a conflict between these Terms and an applicable product and service agreement, the applicable agreement will control with respect to that product or service. In all other cases, these Terms continue to govern your access to and use of the Sites, including AI Agents and account-level features.
Your use of the Sites is subject to the following policies and terms, which are incorporated by reference and available through the links below or on the Website’s Legal Page.
2.1 Acceptable Use Policy
HiveMQ is committed to providing an accessible, inclusive, and respectful Site experience. Please do not use the Sites in a way that violates any laws, infringes on anyone’s rights, is offensive, or interferes with the Sites or any features on the Sites (including any technological measures we employ to enforce these Terms).
All visitors to the Sites and all users of any HiveMQ AI Agents, whether accessed through the Sites or otherwise—must comply with HiveMQ’s Acceptable Use Policy.
HiveMQ may suspend or restrict access to the Sites, your account, AI Agents, or related features if these rules are violated.
2.2 Privacy Policy
When you use the Sites, HiveMQ may collect (i) information you voluntarily provide (such as forms, inquiries, or AI inputs); (ii) technical and usage data (such as IP address, device, browser type, and interaction data); and (iii) business context information (such as company name, role, or industry).
HiveMQ’s Privacy Policy explains how we collect, use, disclose, and protect personal data in connection with the Sites, related communications, cookies, analytics, social media interactions, and AI-powered features.
2.3 Cookie Policy
HiveMQ uses cookies and similar tracking technologies on the Sites and in certain communications. Details about the types of cookies used, purposes, and how you can manage your preferences are described in our Cookie Policy.
2.4 Individual Use Terms
If you are an individual purchasing HiveMQ products and services for your own personal use, your use of those products and services is governed by HiveMQ’s Individual Use Terms (“Use Terms”).
Acceptance of the Use Terms occurs through explicit clickwrap or by accessing or using the Services purchased under those terms.
2.5 Other HiveMQ Agreements
HiveMQ offers additional agreements that govern the use of its products and services by companies, end users purchasing through partners, and partners themselves (including enterprise subscription agreements, end user license agreements, and partner agreements).
Those agreements (i) are not governed by these Terms unless stated otherwise in the applicable agreement; and (ii) are made available through the Website’s Legal Page or through applicable purchase, onboarding, order form, or partner processes.
You may be required to create an account and specify a password in order to use certain services or features on the Sites. To create an account, you must be at least 18 years old, and you must provide truthful and accurate information about yourself. If your information changes at any time, please update your account to reflect those changes.
If you create or use an account, (i) you are responsible for maintaining the confidentiality of your credentials; (ii) you are responsible for all activity under your account; and (iii) you must promptly notify HiveMQ of any unauthorized use.
If you access the Sites on behalf of a company, you represent that you are authorized to do so.
HiveMQ may make certain products, services, features, or tools available through the Sites on a free, trial, evaluation, or beta basis. All trial, evaluation, and beta offerings are provided “as is”, without warranties, and may be modified, suspended, or discontinued at any time. To the maximum extent permitted by law, HiveMQ disclaims all liability arising from or related to trial, evaluation, or beta offerings.
Trials, evaluation and betas services, accessed via checkout, are governed by Individual Use Terms.
Access to such offerings does not create any obligation for HiveMQ to continue, support, or generally release them.
The AI Agent(s) made available on the Sites (the “Agents”) are designed to provide helpful information, answer common questions, and offer support related to HiveMQ based on available knowledge. Agents are designed to help users understand HiveMQ, its products, and related topics.
While the Agents may help you better understand us, the information provided is for informational purposes only and is non-binding and is not a substitute for any type of professional advice.
We are continuously working to improve our products and services, including Sites features, but Agent may occasionally provide incorrect, outdated, or incomplete information. Their responses do not constitute legal, technical, or professional advice.
Use of Agents is subject to the Acceptable Use Policy, including AI-specific rules and restrictions.
To the extent you post, submit, or otherwise make available content through HiveMQ’s branded social media pages, the Sites, or related features (“User Content”), you represent that you have the right to share such content. You grant HiveMQ a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such User Content solely for purposes of operating, promoting, and improving the Sites, HiveMQ’s offerings, and related communications, subject to our Privacy Policy.
HiveMQ is not responsible for, and does not endorse, any User Content posted or made available by you or by other users or third parties.
HiveMQ does not control and is not responsible for the data practices, content moderation, or policies of third-party platforms. Additional information about how HiveMQ processes personal data in connection with social media interactions is provided in our Privacy Policy.
The Sites may contain links to third-party websites, tools, or services, including payment processors. HiveMQ does not control and is not responsible for their content, terms, or practices.
Your use of third-party services is governed by their respective terms and policies.
8.1 HiveMQ Intellectual Property
All content on the Sites — including text, graphics, logos, software, documentation, videos, and other materials — is owned by or licensed to HiveMQ and protected by intellectual property laws and shall remain the sole property of HiveMQ.
You may use the Sites and their content solely for personal, non-commercial, informational purposes. You may not copy, sell, scrape, reverse-engineer, or misuse the Sites or their content.
8.2 Feedback
If you submit feedback, questions, comments, suggestions, or other content through the Sites, you (i) confirm that you have the right to submit it, and (ii) grant HiveMQ a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, and fully sublicensable right to use, reproduce, modify, distribute, and otherwise exploit such feedback for any purpose, including to operate, improve, market, and support the Sites and HiveMQ products and services, without any obligation to you.
Please do not submit confidential, regulated, or sensitive personal information unless expressly requested.
We provide the Sites and our content using a commercially reasonable level of care, and we do our best to make your experience useful and enjoyable. However, there are certain things we do not promise about the Sites, including AI agents.
OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OF SERVICE, NEITHER HIVEMQ, AFFILIATES, ITS AGENTS OR SERVICE PROVIDERS MAKE ANY SPECIFIC PROMISES ABOUT THE SITES, CONTENT, OR TOOLS (INCLUDING AI AGENTS). THE SITES, CONTENT, AND TOOLS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.
You agree to indemnify and hold HiveMQ harmless from claims arising from (i) your misuse of the Sites; (ii) your violation of these Terms or referenced policies; or (iii) your infringement of third-party rights. This includes any third-party claims arising from your User Content.
EXCEPT WHERE PROHIBITED BY LAW, HIVEMQ AND ITS AFFILIATES, AGENTS, AND SERVICE PROVIDERS WILL BE LIABLE ONLY FOR DIRECT DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITES. AS SUCH, HIVEMQ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR REVENUE, LOSS OF GOODWILL OR REPUTATION, OR THE COST OF REPLACEMENT SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.
THIS APPLIES EVEN IF HIVEMQ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF HIVEMQ ARISING OUT OF OR RELATING TO THE SITES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.
Any disputes must be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction.
Nothing in these Terms limits any mandatory consumer protections available under applicable law.
We reserve the right to modify and update our Sites at any time, with or without notice. We may update, modify, suspend, or discontinue features or functionality of the Sites and if you don’t like any changes you may stop using our Sites at any time.
We may also update or modify these Terms from time to time. Continued use of or log in to the Sites means you accept the updated terms.
14.1 Survival
The provisions of these Terms that by their nature should survive termination or expiration will survive, including without limitation provisions relating to disclaimers, limitation of liability, indemnification, intellectual property, user content, governing law and jurisdiction, and any accrued rights or obligations.
14.2 Right to Suspend or Restrict Access
HiveMQ may, on reasonable grounds, suspend, restrict, or terminate your access to the Sites, any accounts, or any features or tools (including AI Agents), in whole or in part and at any time. Where practicable, HiveMQ will provide notice of such suspension and an opportunity to cure, but HiveMQ may act immediately without notice where required or appropriate, including to address legal, security, or safety concerns.
14.3 Infringement
If you believe any Content on the Sites infringes your copyrights, you may request that we remove the Content from the Sites (or disable access to that Content) contact us at legal@hivemq.com.
