Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs:

  • access to and use of HiveMQ’s Sites;
  • use of HiveMQ services purchased under the Subscription Agreement; and
  • use of HiveMQ’s AI-Agents and AI Features, by any user.

This AUP is incorporated by reference into the Terms of Service and the Subscription Agreement (collectively, the “Terms”). Terms not defined here have the meaning set forth in the applicable Terms.

1. Purpose of This Policy

HiveMQ provides resources, Free Services, paid Services, access to third-party services and AI-Agents intended to help users learn about, evaluate, and use HiveMQ and its products.

This AUP is intended to:

  • ensure lawful, responsible, and secure use of the Sites, Free Services, Services, and AI-Agents;
  • protect HiveMQ, its users, and third parties; and
  • establish clear boundaries for acceptable and prohibited conduct, particularly in connection with AI-Agents and AI Features.

2. General Acceptable Use Requirements

When using the Sites, Services, or AI-Agents, you must:

  • comply with all applicable laws and regulations;
  • act in good faith and in accordance with the intended purpose of the offering;
  • refrain from harmful, abusive, deceptive, or misleading conduct; and
  • follow all applicable instructions and Documentation.

You are responsible for all activity conducted through your access, credentials, payment method, or submissions.

The Sites, Services, and AI-Agents are not intended for users under 18.

3. Sites Free Services, and Services Use

3.1 Permitted Use

You may use the Sites Free Services and Services solely for:

  • informational, evaluation, and personal use; and
  • lawful business or personal non-commercial purposes consistent with HiveMQ’s published materials, Documentation, and agreements.

3.2 Prohibited Conduct

You may not use the Sites, or Services to:

  • violate any law or regulation;
  • misrepresent your identity or affiliation with HiveMQ;
  • scrape, harvest, or automatically extract content or data without authorization;
  • interfere with, disrupt, or degrade the Sites or Services;
  • introduce malware, malicious code, or harmful scripts;
  • attempt to bypass technical, security, or payment safeguards;
  • conduct penetration testing, vulnerability scanning, red-teaming, or similar security testing of the Services or their related systems or networks, except with HiveMQ’s prior written consent and in accordance with any conditions HiveMQ specifies (requests may be sent to security@hivemq.com); or
  • use the Sites, Free Services, or Services to build or support a competing product or service.

4. Use of HiveMQ Software Under the Subscription Agreement

If you access HiveMQ Services under the Subscription Agreement, you must:

  • use them only within the scope permitted by the Subscription Agreement and any applicable Order; and
  • configure and operate them in accordance with the Documentation.

You may not:

  • circumvent licensing or usage restrictions;
  • reverse engineer or decompile the software except where expressly permitted by law (including, for HiveMQ GmbH contracting parties, § 69e UrhG for decompilation for interoperability subject to statutory conditions);
  • use the software in a way that materially degrades HiveMQ systems or other users’ experience; or
  • obstruct or misuse any switching, export, or portability mechanism HiveMQ provides in connection with the EU Data Act or applicable law.

5. User Content, Inputs, and Feedback

If you submit information, feedback, prompts, or other content through the Sites, Services, social media interactions, or AI tools:

  • you represent that you have the right to submit such content; and
  • you should not submit personal, confidential, or regulated data except where a HiveMQ feature expressly permits such submission and it is processed in accordance with the Privacy Policy.

Any use of such content is subject to the data ownership, anonymization, and AI training limitations set forth in the Terms and in Section 6 below.

6. AI-Agents and AI Features

6.1 Scope and Purpose

HiveMQ may provide AI-Agents and AI Features (including generative AI capabilities and agent behavior embedded in Sites, Cloud Services, and standalone AI-Agents such as Beatrice) to help users understand HiveMQ, its products, Documentation, and related services. These tools are intended for informational, evaluation, operational, and educational purposes.

6.2 AI-Generated Content

Depending on your subscription or the AI Feature you use, you may input prompts and other text (“Inputs”) and receive AI-generated outputs (“Outputs”). As between you and HiveMQ, your Inputs and the resulting Outputs are your User Content. You acknowledge that other users of the Services may, through no fault of HiveMQ, use inputs similar to yours and, as a result, receive the same or similar outputs; Outputs generated for other users based on their inputs are not your User Content.

Aggregated and Anonymized Use. HiveMQ may take input and outputs in an aggregated and anonymized manner to help improve its Sites and Services.

6.3 Usage Limits and Add-Ons

Depending on your Subscription, you may have limits on your use of HiveMQ’s generative AI features. If you exceed those usage limits, HiveMQ may require you to purchase additional capacity or units to continue accessing and using the generative AI features. Any additional generative AI capacity or units you purchase (i) will be tied to your then-current Subscription, (ii) are not transferable to another account, and (iii) will not be refunded upon expiry or termination of your Subscription.

6.4 AI Usage Restrictions

When using AI-Agents or AI Features, you must not:

  • rely on AI-generated Outputs as legal, technical, security, or professional advice;
  • submit personal data, confidential information, or regulated data unless expressly permitted;
  • use AI tools to generate misleading, deceptive, abusive, or harmful content, or content that infringes, violates, or misappropriates HiveMQ’s rights or the rights of any third party;
  • attempt to manipulate, exploit, bypass, subvert, extract, or reverse engineer any AI system, model, or its safety, moderation, or behavioral controls;
  • use Outputs to develop or train foundation models, large language models, or other AI systems that compete with HiveMQ’s Services;
  • access an AI Feature for the purpose of monitoring its availability, performance, or functionality, or for benchmarking or competitive analysis;
  • represent Outputs as human-generated where doing so would be misleading or deceptive; or
  • use AI tools in a manner that violates applicable law or HiveMQ policies.

Your use of AI-Agents and AI Features must also comply with Section 3 (Sites and Services Use) and Section 5 (User Content, Inputs, and Feedback) of this AUP.

6.5 Nature and Limitations of AI Outputs

AI-generated responses:

  • may be inaccurate, incomplete, or outdated;
  • do not constitute binding guidance, representations, or commitments by HiveMQ; and
  • should be independently verified before being relied upon.

AI-Agents do not make automated decisions that produce legal or similarly significant effects concerning individuals.

6.6 Prohibited AI Uses and Legal Compliance

You may not use HiveMQ’s AI-Agents or AI Features in any manner that would cause HiveMQ to develop, deploy, enable, or facilitate AI practices that are prohibited under applicable law, including the EU Artificial Intelligence Act.

Without limitation, prohibited uses include using AI tools to:

  • manipulate, deceive, or coerce individuals in a manner likely to cause harm;
  • exploit vulnerabilities of individuals or groups;
  • evaluate, score, classify, or profile individuals in ways that result in unlawful, unfair, or harmful treatment;
  • infer or attempt to infer sensitive personal attributes; or
  • otherwise engage in AI practices that HiveMQ has determined are not permitted.

HiveMQ reserves the right, in addition to any other rights it may have, to suspend or restrict access to AI-Agents or AI Features where use reasonably appears to violate this Section 6 or applicable law.

6.7 Enforcement Across All Access Models

HiveMQ may enforce this Section 6 against any user of AI-Agents or AI Features, regardless of whether access is obtained through the Sites, self-service Services, or Enterprise access.

6.8 Abuse, Harassment, and Malicious Use of AI Tools

AI-Agents and AI Features must be used responsibly and in good faith.

You may not use Beatrice or any other HiveMQ AI-powered tool to:

  • harass, threaten, abuse, or demean any individual or group;
  • generate content intended to intimidate, shame, defraud, or harm others;
  • facilitate malicious activity, including social engineering, fraud, or system abuse;
  • generate misleading or deceptive content intended to cause confusion or harm; or
  • otherwise behave in a manner that is intentionally harmful, hostile, or abusive.

PUT SIMPLY: do not use HiveMQ’s AI tools to be a jerk, to harm others, or to enable harmful behavior.

7. Social Media Interactions

HiveMQ maintains branded social media pages and may engage with users through third-party platforms.

When interacting with HiveMQ on social media platforms, you must:

  • engage respectfully and lawfully;
  • refrain from posting abusive, defamatory, infringing, or misleading content;
  • avoid impersonating HiveMQ or its personnel; and
  • comply with the applicable platform’s terms and policies.

HiveMQ reserves the right to moderate, hide, remove, or report content, and to block or restrict users, where permitted by the applicable platform, if interactions violate this AUP or applicable law.

Data collection and processing in connection with social media interactions are governed by HiveMQ’s Privacy Policy and the privacy policies of the relevant platforms.

8. Enforcement and Consequences

HiveMQ may investigate suspected violations of this AUP.

If HiveMQ reasonably believes this AUP has been violated, it may:

  • suspend or restrict Sites or services access;
  • limit or disable access to AI-Agents;
  • terminate accounts; and/or
  • take other actions permitted by applicable terms or law.

HiveMQ may take action without prior notice where necessary to protect users, systems, security, or legal compliance. Any suspension or termination of Services is subject to the applicable governing agreement, including any notice, cure, or refund rights set forth therein.

9. Reporting Violations

10. Updates to This Policy

HiveMQ may update this AUP from time to time. Material changes will be communicated where required by law, as described in HiveMQ’s prior versions. Where a change is required by law (including a new EU AI Act obligation entering into force), that change takes effect on the effective date required by law even if less than the standard notice period.

Continued use of the Sites, Services, or AI-Agents after an update constitutes acceptance of the revised AUP.
